[Q] Droid Razr M on AT&T topic

I don't use a lot of data maybe about 50MB-250MB, I use about 25-175 minutes a Month, AT&T has Data Connect Pass, 1GB for last 90 days. I use Google Voice currently and have it set up in hangouts.
Would it be possible to use the Connect Pass in the phone without AT&T throwing a fit? Would they be able to decent I'm using a Smartphone?
